General Terms & Conditions

These General Terms & Conditions (“Terms”) apply to all services provided by Éclore Clinics BV, registered at Smakkelaarshoek 5, 3511EC Utrecht, Chamber of Commerce (KVK) number: 94714959. By booking an appointment or using our services, you agree to these Terms.

1. Definitions

“Éclore Clinics”: Éclore Clinics in Utrecht and/or consultants, specialists, and employees working for it.

“Client”: Any individual who books or receives services from Éclore Clinics.

“Service”: Any treatment, consultation, activities including investigations of suitability for treatments that relate to the client who places an order for any treatment with Éclore Clinics or products provided by Éclore Clinics.

“Agreement”: The contract formed between the Client and Éclore Clinics when a service is booked.

“Products”: Any products used during any treatment and/or supplied by Éclore Clinics.

2. Applicability

– These Terms apply to all agreements and services between Éclore Clinics and its Clients.

– Éclore Clinics may at all times refuse to perform a treatment and is also entitled to refuse an unreasonable or unusual request/desire from any client.

– Any deviations from these Terms require written consent from Éclore Clinics.

3. Service Agreement

The agreement is formed once the Client instructs Éclore Clinics to investigate the suitability for treatments. Éclore Clinics will propose the treatment plan and pricing to the client based on consultation and research. Clients must provide all necessary health information before treatment. Éclore Clinics will advice on the number of treatments to be followed, the expected results, risks and consequences to the best of their knowledge. Clients must carefully read the treatment agreement and complete it in full before the start of the treatment.

4. Treatment

Treatments are performed to the best of our abilities, in line with professional standards. However, Éclore Clinics cannot guarantee specific outcomes as results may vary per individual. 

5. Cancellation Policy

Consultations: must be canceled at least 24 hours in advance, or a fee of €40 will apply due to the reserved time in the clinic.

Treatments: Cancellations within 24 hours or no-shows incur a minimum fee of €80 due to the reserved time in the clinic and the costs incurred by the clinic to prepare for the treatment. Applied fees must be a reasonable compensation for the loss suffered by the clinic and lost profit depending on the specific treatment booked by the client.

Deposits: Appointments that are cancelled by the client before the treatment for which a deposit has been paid by the client will be not refunded. The cancellation is the responsibility of the client and is registered at the moment the cancellation is received by Éclore Clinics.

6. Payment

– Clients owe Éclore Clinics the agreed price stated in the treatment plan proposed by Éclore Clinics. Clients agree to the price upon instructing Éclore Clinics to perform the treatment or upon booking a treatment online or via direct contact with Éclore Clinics. 

– Clients owe Éclore Clinics the price stated on Éclore Clinics Official Website or other booking platforms. Clients agree to the price upon instructing Éclore Clinics to perform the treatment or upon booking a treatment online or via direct contact with Éclore Clinics. 

Payments are due at the time of booking or immediately following the treatment.

Clients are responsible for reclaiming costs from their insurance, if applicable.

7. Privacy and Confidentiality

Éclore Clinics complies with GDPR. Client data is used exclusively for service delivery and kept confidential unless legally required to disclose it.

8. Liability

Éclore Clinics is not liable for any damage or loss of personal belongings. Damage to property of Éclore Clinics will be recovered in total by the guilty party. Liability for treatment-related issues is limited to the amount covered by our insurance. A complaint does not suspend the client’s payment obligation.

9. Complaints Procedure

Complaints should be addressed to Éclore Clinics via info@ecloreclinics.com. We aim to resolve all complaints amicably within 7 working days. 

10. Governing Law

All agreements between Éclore Clinics and Clients are governed by Dutch law, with disputes subject to the jurisdiction of the courts in The Netherlands.

11. Amendments

Éclore Clinics reserves the right to amend these Terms at any time, with changes communicated via our website or directly to Clients.

12. Miscellaneous

If any provision of these Terms is invalidated, the remaining provisions remain in force. These Terms constitute the entire agreement between the parties.

Éclore Clinics reserves the right to change the General Terms and Conditions at any time without prior notice.
